Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and CasaCrow Inc., a Delaware corporation (“CasaCrow,” “we,” “us,” or “our”) governing your use of the CasaCrow website and application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility — United States only

You must be at least 18 years old and able to form a binding contract to use the Service.

CasaCrow is offered solely to residents of the United States, for residential property located in the United States. We do not offer, market, or sell the Service in any other country. By creating an account you represent that you reside in the United States and that any property you add is located in the United States. Paid plans require a United States billing address, and we may decline, suspend, or terminate any account or purchase that does not meet these requirements.

The Service is built entirely around United States mortgage practice — PMI and the federal Homeowners Protection Act, escrow accounts, county property-tax assessment and appeal calendars, and U.S. market rate data. It is not designed for, and will not produce meaningful results for, a mortgage outside the United States.

The Service may be reachable from outside the United States. Being able to load a page is not an offer of the Service in your country. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with your local laws.

2. Your account

CasaCrow uses passwordless email sign-in. You are responsible for maintaining control of the email account associated with your CasaCrow account and for all activity under your account. Notify us promptly at support@casacrow.com of any unauthorized use. You agree to provide accurate information and keep it current.

3. Subscriptions, trials, billing, and cancellation

• Plans. CasaCrow offers a free tier and a paid “Pro” plan billed at $8.00/month or $60.00/year (plus applicable taxes), as shown at checkout. A discounted founding-member rate may be offered to a limited number of accounts and, once claimed, is locked in for as long as the subscription stays active. We also offer the PMI Removal Kit as a one-time, non-recurring purchase for $99.00 (included at no extra cost with the annual Pro plans, including the founding-member rate; it is not included with month-to-month billing). Prices may change; we will give advance notice and changes will not affect your current paid term.
• Free trial. We offer a 14-day free trial on the annual Pro plan, limited to one trial per account. It is not available on month-to-month billing or on the founding-member rate, which begin billing immediately. If you do not cancel before the trial ends, your selected plan begins and your payment method is charged automatically. You keep Pro access for the remainder of the trial period if you cancel during it. During the trial, all Pro features are active except one: the PMI Removal Kit’s lender-letter download, which unlocks with your first payment — the rest of the Kit (your removal dates, the appraisal playbook, and tracking PMI removal) is available throughout the trial, and the Kit is also purchasable outright at any time for $99.00.
• Auto-renewal. Paid subscriptions renew automatically at the end of each billing period until you cancel. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis.
• Cancellation. You may cancel anytime from your account; cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
• Refunds. Except where required by law, payments are non-refundable and partial periods are not pro-rated. Any retention or win-back discounts are offered at our discretion.

4. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• upload content you lack the rights to, or that infringes others’ rights;
• attempt to access accounts or data that are not yours, or probe, scan, or test the security of the Service without authorization;
• interfere with or disrupt the Service, or circumvent rate limits or usage limits;
• reverse engineer, scrape, or resell the Service except as permitted by law.

5. Your content

You retain ownership of the documents and information you submit (“Your Content”). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the rights to submit it.

6. Intellectual property

The Service, including its software, design, text, and trademarks, is owned by CasaCrow and its licensors and is protected by law. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, non-commercial use in accordance with these Terms. No other rights are granted.

7. Third-party services

The Service relies on third parties (including Stripe, Supabase, Resend, and Vercel) and may reference third-party data (such as market rates from public sources). We are not responsible for the acts, omissions, content, or policies of third parties, and your use of their services may be subject to their own terms.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Without limiting the above, we do not warrant that the Service’s calculations, projections, alerts, or market-rate data are accurate, complete, current, or suitable for your situation, or that the Service will be uninterrupted, secure, or error-free. You are solely responsible for decisions you make based on the Service.

9. Limitation of liability

To the maximum extent permitted by law, CasaCrow and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless CasaCrow from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including Sections 5–13) will survive.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

Please read this section carefully. It affects your legal rights. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. You and CasaCrow waive any right to a jury trial and to participate in a class, collective, or representative action.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@casacrow.com with your name and a statement that you opt out. Arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules, and the hearing locale will be determined under those rules.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date. Where the law requires us to give you additional notice of a change, or to obtain your consent before it takes effect, we will do so. We may also choose to notify you of other changes, though we are not obliged to. Each time you sign in you are asked to agree to the Terms then in force, and we record which version that was; your continued use of the Service after an update also constitutes acceptance of the revised Terms.
